SAP Services for Employers, DERs & C/TPAs
A clear referral process, required SAP reports, and virtual evaluations for DOT-regulated employees throughout California.
FMCSA drivers: In the FMCSA Clearinghouse, select Richard Donovan as your SAP.
Required reports, directly to the DER
Following the initial evaluation, I send the required signed and dated SAP report directly to the DER. After the follow-up evaluation, I report my determination of whether the employee has demonstrated successful compliance.
Reports go directly to the DER. A C/TPA may receive a copy at the same time; it does not replace direct delivery to the DER. If the employee has no current employer, the applicable reports are provided directly to the employee and to a gaining DOT employer as required.
Compliance and follow-up testing
I review education or treatment documentation and evaluate the employee’s participation before determining successful compliance. Completion paperwork alone does not replace the follow-up evaluation.
After successful compliance, I provide the written follow-up testing plan directly to the DER. The employer arranges return-to-duty testing and carries out the unannounced follow-up testing requirements. The confidential testing schedule is not given to the employee.
The employer decides whether to return the employee to safety-sensitive duties after all applicable requirements are met.
Clearinghouse SAP reporting
For FMCSA cases, the driver designates Richard Donovan as the SAP in the Clearinghouse. I complete the required SAP entries for the initial evaluation and the determination of eligibility for return-to-duty testing.
Employer and C/TPA Clearinghouse responsibilities remain with the appropriate reporting party. SAP reporting does not replace employer reporting or the required return-to-duty test.
